1. Acceptance of Terms

By downloading, installing, or using PreRun.io ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

PreRun.io is a GPS navigation application designed for off-road and recreational use. The App allows users to import GPX route files, follow routes with turn-by-turn audio guidance, add waypoints, and visualize routes on a map.

3. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The App will be error-free or uninterrupted
• GPS positioning will be accurate at all times
• Route information, directions, or waypoint data will be correct, complete, or current
• The App will be suitable for any particular purpose, including navigation in hazardous or remote terrain
• Map data provided by third-party services (Mapbox) will be accurate or up-to-date

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRERUN.IO, ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

This includes, but is not limited to, damages arising from:

• Reliance on GPS positioning, route directions, or waypoint data provided by the App
• Inaccurate, incomplete, or outdated map or route information
• Vehicle damage, personal injury, or death resulting from following routes or directions provided by the App
• Loss of data, including GPX files, waypoints, or track logs
• Service interruptions, GPS signal loss, or device malfunction
• Actions taken based on AI-generated trail or route suggestions

5. Assumption of Risk

Off-road driving, trail navigation, and backcountry travel are inherently dangerous activities. By using PreRun.io, you acknowledge and accept the following:

• You are solely responsible for your safety and the safety of your passengers and vehicle
• You will not rely exclusively on the App for navigation in remote, hazardous, or unfamiliar terrain
• You will carry appropriate backup navigation tools (paper maps, compass, secondary GPS device)
• You will assess road and trail conditions independently before proceeding
• You will comply with all applicable traffic laws, land use regulations, and access restrictions
• You will not use the App in any manner that distracts you while operating a vehicle

6. Off-Road Use

PreRun.io is intended for off-road, recreational, and pre-running purposes. The App is not designed or intended for use as a primary navigation system on public roads. Use on public roads is at your own risk and discretion.

7. User Accounts and Subscriptions

• You are responsible for maintaining the security of your account credentials
• You may not share your account with others or allow multiple simultaneous users
• PreRun Pro subscriptions are billed annually through Stripe at $49.99/year
• You may cancel your subscription at any time; access continues through the end of the billing period
• Refunds are handled on a case-by-case basis; contact support@prerun.io

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the source code of the App
• Use the App to trespass on private property or access restricted areas
• Redistribute, sublicense, or resell access to the App or its features

9. Third-Party Services

The App relies on third-party services including Mapbox (maps and routing), Firebase (authentication and data storage), and Stripe (payment processing). We are not responsible for the availability, accuracy, or performance of these services. Your use of these services is subject to their respective terms and privacy policies.

10. Intellectual Property

PreRun.io and its original content, features, and functionality are owned by Big Sky IT LLC and are protected by copyright and other intellectual property laws. GPX files and waypoint data you create remain your property.

11. Indemnification

You agree to indemnify and hold harmless PreRun.io, Big Sky IT LLC, its owners, operators, and affiliates from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. Changes are effective when posted. Continued use of the App after changes constitutes acceptance of the revised Terms. We will update the "Last Updated" date at the top of this page.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict of law provisions.
